Endoscope Services Pty Ltd. guarantees that our products or services are devoid of any defects in materials and workmanship under standard use and service for 90 days from the invoice and shipping date. If a product demonstrates any defects within this warranty period, the customer must send it back to us. After thorough investigation and factory inspection, if we find that (a) the defect occurred under standard and appropriate use, and (b) the product is covered under this warranty, we will, at our discretion, either repair, replace, or adjust the defective product. This will be our only obligation and the customer’s exclusive remedy under this policy. Shipping costs to and from our service facility will be borne by the customer. Preventive maintenance, installation, deinstallation, relocation, or general maintenance tasks are not covered under this policy. We reserve the right to (i) use reconditioned, refurbished, and/or serviceable used parts for warranty repairs that meet our quality standards, and (ii) make internal or external changes to any product without any obligation to incorporate these changes into existing products.
The following are not covered under this warranty:
- Any product that has been disassembled, repaired, tampered with, altered, changed, or modified by anyone other than our authorized service personnel, unless repair by others is authorized in writing by Endoscope Services;
- Defects or damages due to wear, tear, misuse, negligence, inadequate storage, or non-performance of scheduled maintenance.
THIS WARRANTY IS LIMITED TO THE ABOVE TERMS. ENDOSCOPE SERVICES PROVIDES NO ADDITIONAL WARRANTIES, EITHER EXPRESSED OR IMPLIED, REGARDING THE PRODUCTS, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR ANY PATENT OR TECHNOLOGY USED OR INCLUDED THEREIN. IF ANY IMPLIED WARRANTIES ARE APPLICABLE, THEY ARE LIMITED TO THE LENGTH OF THIS WARRANTY. ALL OTHER WARRANTIES, CONDITIONS, AND REPRESENTATIONS ARE EXPRESSLY EXCLUDED. SOME STATES MAY NOT RECOGNIZE SUCH EXCLUSIONS OR LIMITATIONS, SO THEY MAY NOT APPLY. DIFFERENT OR ADDITIONAL RIGHTS OR REMEDIES MAY BE AVAILABLE TO THE CUSTOMER. ENDOSCOPE SERVICES IS NOT LIABLE FOR ANY DAMAGES CAUSED BY DELAYED SHIPMENT, PRODUCT FAILURE, DESIGN, SELECTION, OR PRODUCTION, WHETHER LIABILITY IS ASSERTED IN CONTRACT OR OTHERWISE. WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES (INCLUDING LOSS OF PROFITS OR LOSS OF USE), REGARDLESS OF WHETHER ENDOSCOPE SERVICES IS AWARE OF THE POSSIBILITY OF SUCH POTENTIAL LOSS OR DAMAGE.
Any warranty or representations made by anyone, including dealers and representatives of Endoscope Services, that contradict or conflict with the terms of this warranty, are not binding upon us unless approved in writing by an expressly authorized officer of Endoscope Services.
This warranty is the exclusive and comprehensive statement of the warranty agreed upon by Endoscope Services with respect to the products, and it replaces all prior oral or written agreements, understandings, proposals, and communications on this subject.
This warranty benefits only the original customer and cannot be transferred or assigned.
